Accident at Work
An accident at work can and does happen and as a result you can suffer an injury.
We understand that making a claim against your employer can be worrying. However, it is their responsibility and a legal obligation, to ensure that they are maintaining health and safety standards in your workplace. Your employer is obliged to carry out regular risk assessments of your working conditions, and make any necessary changes or improvements.
If you do suffer an injury as the result of an accident in the workplace you should notify your employer immediately. They are legally required to keep an accident book for you to record any work-related accident or injury and to help avoid others suffering an accident of the same nature.
You can make a claim for compensation if you suffer an injury in a workplace accident where the employer may be in breach of its duties or statutory obligations, which can include:
- In a vehicle being driven for work purposes
- On a building site
- In a factory, including if you have contracted an occupational disease
- In an office
- On a farm
- In a shop
- In a hairdressers or beauty salon, if you have suffered from chemical burns or skin conditions
Making a claim for compensation against your employer may appear to be biting the hand that feeds you. However, if you have genuinely suffered an injury as a result of an accident which could have been avoided, by raising the issue, you may prevent it happening again to another employee.
Often injuries have longer lasting effects than you may initially have envisaged. By seeking legal advice you can make an informed decision whether or not to pursue a claim.
Your employer should have insurance to cover their workforce in the event of injury.
