Fatal Accident Compensation Claims
The death of a loved one is an extremely emotional and upsetting time. Whilst you can never be compensated for the loss of a loved one, a claim for compensation can help ease any financial burden or hardship.
There are normally two main aspects to a fatal accident claim: a claim on behalf of the deceased's estate and a claim on behalf of any dependants of the deceased.
If the accident was not immediately fatal, there may be other aspects to any claim.
For example, on behalf of the estate, a claim might made for:
- Any financial loss prior to the death, i.e. loss of earnings from time spent in hospital since the original accident
- Pain and suffering prior to the death
- Funeral expenses (if paid by the estate)
Or, on behalf of any dependant family members, which could incude a spouse, partner or children, a claim might be made for:
- Loss of financial support
- Funeral expenses (if paid by the dependants)
There may be other potential elements to a claim, including a lump sum bereavement award.
Where there has been a fatal accident, there may also be claims in very specific circumstances, for psychiatric injuries suffered by those involved. This is a specialist area that requires specific legal advice.
