The nose is unfortunately a little more susceptible to fracture damage that we might otherwise like. If you have been involved in an accident, whether a car crash or a trip at work, any facial impact may have led to a nose or nasal complex fracture.

Despite this being considered a minor injury by many, the pain that can come from a nasal complex fracture is no less real than any other, and the emotional and psychological effects of having a slight disfigurement that can come when the nose heals may be enough to justify corrective surgery.

If you have suffered a nose or nasal complex fracture due to an incident that was not your fault, then you may be entitled to financial compensation.

What situations where the nose was fractured can lead to a compensation claim?

Accident in the workplace

During your time at work, your employer has a legal duty of care to provide a safe environment for you to your job. This duty of care includes following any regulations as set by the Health and Safety Executive (HSE), and includes such things as ensuring any environment is clean, clear of obstacles and hazards, and adequately lit.

If you have had an accident at work where you believe that your employer failed to comply with the legal regulations leading to your fractured nose, then you should consider a claim for compensation. This might be because:

  • You were inadequately trained to use machinery and suffered an injury consequently.

  • A spill or other hazard on the floor was not cleaned up, and the area not adequately cordoned off or sign posted.

  • You were encouraged to perform a task outside of health and safety (for example, asked to climb an unsecured ladder, followed by a fall).

  • A section of ceiling was left unrepaired and eventually collapsed on you.

  • Chairs were left in a poor state, presenting a situation where one broke and caused you to fall to the floor, injuring your nose.

Accident in a public place

Like the workplace, any owner of a publicly used venue or space (such as a pub, gym or supermarket) is responsible for providing a safe and hazard-free environment for their customers. This also extends to locations such as parks, or the pavement, where the local council has a duty of care.

If you had an accident in a public place due to a failure in the responsible owner to follow standard safety regulations, then you are entitled to make a claim.

Victim of violent crime

It is unfortunate that many people do not realise that they can pursue a damages compensation claim against their attacker in the case of a violent crime. If you have been the victim of assault, even a ‘minor’ assault like a punch to the face which caused your injured nose, then you may have grounds for a compensation award.

In the cases where the perpetrator of an assault cannot be found or does not have the required funds to fully pay a compensation claim, the court will work with the Criminal Injuries Compensation Authority (CICA) to make sure that the victim receives the financial recompense owed to them.

How much money can I claim for a fractured nose?

Guidelines exist to provide the court with recommended compensation amounts. In the case of a fractured nose, everything relevant will be taken into account from the smallest expense (such as the cost of car parking at the hospital for appointments) to the larger considerations of loss of earnings from time away from work, and financial compensation for pain and suffering.

The guidelines for fractures of the nose and nasal complex are:

Severity Compensation
Simple undisplaced fracture with full recovery£1,360 to £2,010
Displaced fracture requiring no more than manipulation£2,010 to £2,510
Displaced fracture where recovery complete but only after surgery£3,150 to £4,070
Serious or multiple fractures requiring a number of operations and/or resulting in permanent damage to airways, difficulty breathing and/or nerves or tear ducts and/or facial deformity£8,480 to £18,440

What is No Win No Fee?

A ‘No Win No Fee’ agreement is a common term for what is more technically referred to as a Conditional Fee Agreement (CFA). This is a formal and legally binding arrangement between you and your solicitor that details how no fees or charges will apply unless the case is successful and an award made.

At Accident Line Direct we work on a No Win No Fee basis because we believe that everyone, no matter their financial situation, is entitled to top-quality professional legal representation when they have been wronged. There is no small print, and there are no hidden fees – just a clear arrangement which states that we make our money as a small percentage of the final compensation award. In this way, when you win, so do we!

Our expert legal team will work to the peak of their capacity to bring your claim to the best financial result possible, working with you every step of the way to reach a desirable outcome. Should, however, the claim not result in an award, then you will not be responsible for any of our fees.

Does it matter how long ago my nose fracture occurred?

Compensation claims must be initiated within three years from the date of the initial injury. If you believe that time is about to pass, or if you are unsure of the precise dates then we advise that you contact us immediately.

If you are confident that the fracture happened less than three years ago, then you can legitimately proceed with a claim for fractured nose or nasal complex compensation.
